These Terms & Conditions ("Terms") govern your access to and use of the website businesscontacts.io(the "Platform") and the products and services offered on it (the "Services"). The Platform is owned and operated by Exavibes Services Private Limited("Company", "we", "us", "our"), a company incorporated in India with its registered office at E-402 Ambika Darshan, CP Road, Kandivali East, Mumbai 400101, Maharashtra, India and operating office at 912 Gold Crest Business Center, LT Road, Borivali West, Mumbai 400092, Maharashtra, India.

By accessing the Platform, creating an account, or purchasing any Service, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Eligibility

The Services are intended for business use only. By using the Platform you represent that you are at least 18 years of age, are using the Services on behalf of a business, and have the authority to bind that business to these Terms.

2. The Services

We provide access to curated business contact databases organised by industry category, including business emails, phone numbers, job titles and company (firmographic) information ("Data"). Access is provided through paid subscription plans measured in contact credits, or through custom datasets agreed separately in writing.

3. Accounts & Credits

• You are responsible for maintaining the confidentiality of your account credentials.
• Contact credits are consumed when a full contact record is unlocked or exported.
• Credits are valid for the plan period stated at purchase and are non-transferable.
• We may suspend accounts that show signs of abuse, credential sharing, or automated scraping.

4. Permitted Use of Data

You may use the Data solely for your internal business purposes, including lawful B2B sales and marketing outreach. You must:

• comply with all applicable laws, including the GDPR (where applicable), CAN-SPAM, and the telemarketing and anti-spam regulations of your jurisdiction;
• honour opt-out and unsubscribe requests promptly;
• not resell, sublicense, redistribute or publicly publish the Data;
• not use the Data for unlawful, deceptive, discriminatory or harassing purposes; and
• not use the Data to build or train a competing database or product.

5. Payments, Pricing & Taxes

All prices are displayed and billed in US Dollars (USD). Payments are processed securely by our payment partner Razorpay; we do not store your card or banking credentials. You are responsible for any taxes, duties, currency-conversion or bank charges applicable in your jurisdiction.

6. Refunds & Cancellation

Refunds and cancellations are governed by our Refund & Cancellation Policy, which forms part of these Terms.

7. Data Accuracy Disclaimer

We employ multi-step verification and target 95%+ email deliverability, but business data changes constantly. The Data is provided on an "as is" and "as available" basis. We do not warrant that any individual record is accurate, current or complete. Our sole obligation for inaccurate records is the replacement remedy described in our plans.

8. Intellectual Property

The Platform, its design, software, databases and content are the property of the Company or its licensors and are protected by applicable intellectual property laws. Purchasing a plan grants you a limited, non-exclusive, non-transferable licence to use the Data as described in Section 4 — it does not transfer ownership of any database or content.

9. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill or data, arising from your use of the Platform or the Data. Our aggregate liability for any claim shall not exceed the amount paid by you for the Services in the three (3) months preceding the claim.

10. Indemnity

You agree to indemnify and hold harmless the Company, its directors, employees and agents from any claims, damages or expenses (including legal fees) arising from your use of the Data in violation of these Terms or applicable law.

11. Termination

We may suspend or terminate your access for breach of these Terms. Upon termination, your licence to use unexported Data ends and unused credits lapse, except as expressly provided in the Refund & Cancellation Policy.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified on the Platform or by email. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
